anyway. a full like at your time-saver traffic in just a moment. >> because we can okay. 4:34. oakland police are investigating two deadly shootings this morning from last night on mcarthur boulevard the first on the 9000 block just before 9:00. a man was shot several times pronounced dead at the scene there. the other was about an hour and a half later on the 2000 block of macarthur, as well. that man was also dead at the scene. so far there are no suspects in either case. later this mornings the superintendent of a school district in albany will address the death of a teacher. james izumizaki was a popular sixth grade teacher but was recently charged with lewd acts with a former student. he was arrested last wednesday and was out on bail when he was found dead. the alameda county sheriff's office is investigating the death as a suicide. today a san mateo man is expected to enter a plea in an alleged kidnapping case. he is accused of trespassing on the campus of parkside

elementary school and briefly abducting a 9-year-old girl. the alleged offenses happened on september 21. and police say the girl got away by kicking the suspect and runningback to the school. 4:35. more than 20 people were hurt in two separate train crashes in the san joaquin valley. the latest crash, a big rig slammed into a freight train near the town of hanford. the truck driver suffered minor injuries. several hours before that, and 15 miles away, there was another crash. this also involved a big rig. this time, though, it hit an amtrak train. about 40 passengers on that train were injured. none seriously, though. the amtrak train headed from oakland down to bakersfield. police say the driver didn't yield at the crossing gate, slammed right into the train pushing at least one car off the tracks. >> reporter: how did you not see the train was crossing, the arms were down? >> i don't know if there was any indication of use of alcohol or drugs. >> the tracks could be cleared about 7 a.m. until then a bus bridge is

taking passengers around that accident area. a local city leader says won't be intimidated. vallejo mayor osby davis' private law firm was purposesly torched over the weekend, gutting the building. this isn't the first time he has been targeted. davis has had numerous windows broken out by rocks and while he believes someone is trying to intimidate him, he says it's not working. >> i believe that the last criminal act is part of an escalating entertainment to intimidate me. it has failed. >> the mayor and his family are not getting extra police protection despite the attacks. in other headlines, testimony is set to continue today in the trial of giselle esteban accused of murdering nursing student michelle le in hayward last year. in opening statements yesterday, prosecutors blamed a jealous rage for prompting esteban to kill her former friend. the defense says it was not

premeditated but done in the heat of passion. the body of one of two missing fishermen has washed ashore in the san mateo county coast. the man was aboard an 18-foot fishing boat when it capsized on sunday off pidgeon point. a second man is still missing. neither were wearing life jackets. two other men on board were wearing life jackets and made it safely to shore. chevron is on the agenda when the richmond city council meets tonight expected to approve a resolution to be sure the oil company uses the highest standards and the best technology when it repairs the refinery that burned two months ago this past august. the council is also expected to urge chevron to invest in research and office space in richmond's marina bay district. an east bay fire district is hiring a federal grant of $8 million enabling the east contra costa fire district to rehire laid-off firefighters and even add more staff.

the district plans to fill 15 firefighting positions it eliminated over the summer and will hire a dozen more. the fire chief is searching for qualified applicants and three fire stations that had to close will now get to reopen. police in hong kong say six crewmembers from two boats are being detained after a collision that killed 37 people. a ferry collided last night with a boat taking utility company workers and their families to victoria harbor for a fireworks show. more than 100 people were sent to hospitals. the accident happened last night near lama island off the southwestern coast of hong kong. new video has surfaced showing missing american journalist austin ties surrounded by anonymous captors but the brief clip shed little light on his whereabouts or condition. the freelance writer has been missing since august. no group claimed responsibility so far but u.s. state department spokeswoman victoria new land told reporters

for today staying hot. i think this will be it though. by tomorrow, we'll probably notice a 10-degree drop in some of the warmer temperatures around the bay area so enjoy it while we have it. it will be hot in the central valley, 100 sacramento and fresno, 95 in yosemite and 82 in monterey bay. around the bay today you will see sunshine and plenty of it. 93 degrees in san jose. 97 in morgan hill and about 94 degrees in campbell. east bay temperatures triple digits into livermore, 102 in pleasanton, 99 in pleasant hill, and as you slide inside the bay you'll find plenty of sunshine, maybe as high as 86 degrees today in san francisco. 75 in daly city and about 78 degrees in bodega bay that's a warm day along the north bay. how about this for temperatures the next couple of days. hot today and then dropping off tomorrow. but toward the weekend, a few more clouds roll our way. those temperatures may be cooling below average as we look toward sunday and into monday. let's check the roads now with elizabeth. >> nothing hot to speak about. no big hotspots so far this morning at 4:45. we are accident-free for the

most part across the bay area. nothing much to really slow you down. so here's a live look at the bay bridge toll plaza. and as you can see, everything moves nicely into san francisco. let's go to our maps, show you what else is going on. there is some overnight roadwork in lanes still on westbound 84. it's kind of interesting because we can still see a little bit of slowing on our sensors in that area. again, that's westbound 84, caltrans says that is scheduled to wrap up by about 5:00. if you are heading into san francisco today, once again we have that howard street closure south of market. howard is shut down between 3rd and 4th. they have oracle open world going on in that area. so it really has been causing a mess of a commute. my traffic producer says every day she has to take bart if she is in that area because there's just such congestion around that south of market area because of that one block of howard being closed. back outside, here's a live look "timesaver traffic" camera this is the nimitz, dark, but the oakland coliseum is there in the distance. taillights are moving northbound and overall, it's a

nice drive between hayward and downtown oakland. similar story if you are commuting even farther south through milpitas. a live look at 880/237. mass transit is on time of the we have been off to a great start including all those bart trains. that's a check of your "timesaver traffic." traffic and weather together every 10 minutes, back to you. >> thank you. a new report says nearly all americans will see higher taxes if congress fails to renew tax cuts set to expire at the and of the year. the two major parties are split on exactly who should continue to have reduced taxes. if a plan is not passed by the end of the year, the existing tax cuts will come to an end. the tax policy center says as for an example here a family earning 40,000 to $6,000 a year could see taxes go up by 2,000 in 2013. the young man who was involved in deadly sniper a tax in the d.c. area is talking from prison. lee boyd malvo took part in the shootings that began 10 years ago today.

10 people in all were killed. malvo was 17 at the time and laughed about the shootings when he was arrested. now he is talking in a different tone from a virginia prison where he is serving a life sentence. i was a monster. i mean, if you look at the definition of a monster, that's what a monster is. >> malvo got a life sentence instead of death because jurors believed he was under his accomplice' control during the crime. american airlines has engineers in new york checking the seats on eight boeing 757 jets. the inspections came after two incidents where rows of seats came loose from the airplane floor. it happened yesterday in a flight from new york to miami. again on saturday, on a boston- to-miami flight that made an emergency landing in new york because of pilot concerns. >> we don't know what kind of turbulence we have. the seat is loose.

we don't want that thing flying around and hurting the passengers behind us. >> good idea. both planes recently had maintenance work that involved removing those seats. the work was done at separate facilities. american says the problem could be with the way the seats fit into the tracks on the floor. airline and the faa as you might imagine are investigating right now. so we would like to know, does the loose seat problem make you afraid to fly? check in on facebook or twitter. a fire risk means a recall for more than half million honda cars. honda is recalled accord v-6 models. the models from 2003 to 2008 need power steering hoses replaced because they could leak and cause a fire. the fix will be free but replacement parts won't be available until next year. spirit airline passengers, get ready to pay more if you want to carry your bag on board. beginning next month, spirit will charge as much as $100 per bag. spirit says so many customers are waiting until they reach

and you look at the green fields and you don't see anyone playing out there. >> the owner of the egg farm said he would not comment until after he reads the lawsuit. the family member telling cbs 5 by phone the company never claims its hens were free range but they were cage-free and have access to open fields. several grocery chains are pulling peanut butter products off store shelves over concerns of salmonella contamination. the retailer is recalling store brand peanut butter including safeway, target, whole foods and "fresh & easy." the centers for disease control says 30 people in 19 states have gotten sick including two right here in california. in healthwatch, the hpv vaccine is generally safe and has only minor side effects. that's all according to a new kaiser permanente study. researchers say the vaccine appears to be associated with fainting the day of the shot and skin infections two weeks after. vaccine protects against the human papilloma virus, a common
